1. Operator Information

2. Scope of Application

These Terms & Conditions ("Terms") govern the contractual relationship between the Operator and any individual registering for or using the platform ("User").

By creating an account, the User enters into a binding agreement with the Operator and agrees to these Terms.


3. Description of the Service

The Operator provides an online AI-based language examination simulation platform.

The service may include:

  • Simulated oral examination environments
  • Automated performance evaluation
  • Feedback on pronunciation, fluency, and coherence
  • Storage of audio submissions

The service is provided in its current form. The Operator reserves the right to modify, expand, restrict, or discontinue features at any time.


4. Beta Status

The platform is currently provided as a beta version.

The Operator does not guarantee:

  • Uninterrupted availability
  • Error-free functionality
  • Accuracy or completeness of generated feedback
  • Equivalence of simulated results to official examinations

The platform is intended solely as a training tool.


5. No Affiliation

The Operator is not affiliated with, endorsed by, or connected to any official examination authorities or certification bodies unless explicitly stated.

Any references to third-party examinations are for descriptive purposes only.


6. Account Registration

Users must provide accurate and complete information during registration.

The platform is intended exclusively for individuals who are at least 18 years old. By registering for an account, the User confirms that they are at least 18 years of age. The Operator does not knowingly provide services to individuals under 18.

Accounts are personal and non-transferable.

Users are responsible for safeguarding login credentials.

The Operator may suspend or terminate accounts in case of violations of these Terms.


7. User Content and Audio Recordings

The platform records and processes User-submitted audio content for the purpose of:

  • Providing automated feedback
  • Operating and improving the service (where consent has been provided)

Users retain ownership of their submitted content.

By submitting content, the User grants the Operator a non-exclusive, worldwide, royalty-free license to process such content solely for service provision and, where applicable, improvement purposes.

Processing of personal data is governed by the Privacy Policy.


8. Intellectual Property

All platform software, algorithms, branding, content, and design elements are the intellectual property of the Operator or its licensors.

Users may not:

  • Reproduce or distribute platform materials
  • Reverse engineer the software
  • Extract or scrape system data
  • Use the platform for commercial exploitation without permission

9. Availability

The Operator does not guarantee continuous or uninterrupted availability of the platform.

Maintenance, updates, technical issues, or security incidents may result in temporary interruptions.


10. Limitation of Liability

The Operator shall be liable without limitation for:

  • Intentional misconduct
  • Gross negligence
  • Injury to life, body, or health

For cases of simple negligence, the Operator’s liability shall be limited to foreseeable damages typical for this type of contract.

The Operator shall not be liable for:

  • Indirect damages
  • Loss of profits
  • Examination results or certification outcomes
  • Decisions made based on platform feedback

Mandatory statutory rights remain unaffected.


11. Data Protection

The Operator processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

12. Termination

Users may terminate their account at any time.

The Operator may suspend or terminate access if:

  • The User violates these Terms
  • There is suspected misuse or unlawful activity
  • Continued provision of the service is no longer feasible

13. Changes to the Terms

The Operator reserves the right to amend these Terms.

Material changes may require renewed acceptance by the User.

Users will be informed of significant changes in an appropriate manner.


14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Federal Republic of Germany.

If the User is a merchant within the meaning of German commercial law, the place of jurisdiction shall be the Operator’s registered office.

Mandatory consumer protection provisions remain unaffected.


15. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions shall remain in full force and effect.
